Deputy Chief Justice Of Soc Trang Provincial People's Court Is Prosecuted Because Of Issuing Illegally Judgments

According to Nguoi Lao Dong Newspaper, at the end of October, the Investigation Agency of the Supreme People's Procuracy has issued a decision to prosecute the Deputy Chief Justice of Soc Trang Province with the act of issuing illegally judgments.

Mr. Nguyen Van Thanh Binh - Deputy Chief Justice of Soc Trang Provincial People's Court previously accepted the case of selling the house; the Supreme People's Procuratorate has reviewed the case and issued a decision to prosecute the act of issuing illegally judgments of the defendant (for bail).

Nguyen Thi N. who lives in Ward 2, Soc Trang City bought a house owned by Mr. Dang Van M., legally certified on February 6, 2013.  The next 2 days is February 8, 2013 Mrs. N. sold the house to Mr. P. in Ho Chi Minh City and received 2 billion deposit. In the contract agreement within a month Ms. N must complete the procedure to transfer the name from Mr. M. to Mr. P  at Soc Trang Notary Public (from March 8, 2013)

On February 21, 2013, Mr. M's ex-wife sent a lawsuit to the Soc Trang Province People's Court requesting the cancellation of transaction of sale the house between Mr M. and Mrs N. with the reason "Her ex-husband owes money, The court applied the provisional measure, forbidding M. to sell the house. "Thanh Binh Judge accepted the request of M’s ex-wife,  issued a decision "temporary emergency" No. 01 on 22 February 2017 forced Mr. M. to cancel the house sale contract.

The Supreme People's Procuracy said that the decision of Mr. Binh- the judge of the case is illegal. Because Mr. M. and his ex-wife had a clear division of property, on February 27, 2012, the Soc Trang Province People's Court decided to grant Mr. M. the full right to use and dispose of the house. However, Binh Judge accepted the request to intervene in the property of his wife M. The sale of Mr M and Mrs N's house failed, leading to Ms N.'s betrayal of Mr. P. and Mr. P requires a 2 billion USD deposit, and claims 2 billion USD as committed in the contract.

Under the agreement between Ms. N and Mr. P., In addition to the deposit, Ms. N. is reduced compensation to 1.9 billion. However, at the hearing held by Mr. Binh - Deputy Chief Justice of Soc Trang Province, Mr. Binh did not acknowledge the agreement, Mr. P. only received 2 billion dong of deposit, the compensation is not considered.
